Free Physician Case Screening to Get You Started

Several lawyers from small law firms or practicing alone have told us that if not for this free service, they would not be able to accept medical negligence claims due to the high “expert witness” expenses they have had to pay to other agencies, just to identify claims that are meritorious.

For larger law firms, utilization of our case screening service is like having a physician on staff to sort through cases and provide insight into the case strengths and weaknesses.

FMP provides clients with advanced case screening, completely cost free.

This includes an initial, detailed teleconference between the attorney and a board certified, exceptionally experienced physician knowledgeable in the medical specialties most pertinent to their specific case. Frequently, this screening is sufficient to identify cases that are not meritorious as well as plaintiff’s cases that are not likely to result in a successful outcome. This allows for our clients to dismiss these cases without the need to spend any  money.

Our clients find this to be a very  valuable free service. Several lawyers from small law firms or practicing alone have told us that if not for this free service, they  would not be able to accept medical negligence claims due to the high “expert witness” expenses they  have had to pay  to other agencies just to identify  claims with merit.

For cases determined to be meritorious, the physician will discuss with the attorney specific issues regarding negligence and causation; the pros and cons of litigating the case; and foreseeable expert requirements along with the associated expert fees for building a successful case outcome.

When teleconference review of the available case materials proves insufficient to reach a determination of merit, the attorney may be invited to provide select case records, usually via email or fax, so that an informative follow-up teleconference can be continued after the expert has considered these materials.

All this is provided before our clients spend any  money.

“Important Aspects of Providing Professional Expert Services,” is not a course covered in medical school or an academic rotation of any US residency training program. Hence, before being made available to our clients, all of our experts are versed in topics critical to providing effective expert services, including: standard of care; tort (duty, breech, causation and damages); medical negligence; reasonable medical certainty; accepted complications; iatrogenic injury; causation; reasonable medical probability; affidavit of merit; preparation of expert reports; preparing for and providing expert depositions; preparing for and providing expert trial testimony; effective cross examination; defining and defending expert opinions; credibility; courtroom dress and demeanor; effective layperson communication; the Daubert standard; the Frye test; and use of the Bradford Hill Criteria in causation.

FMP experts provide unbiased analysis and straightforward expert opinions they are prepared to support vigorously with unwavering conviction when testimony is called for.

Our experts understand the valuable role medical professionals can play in policing the quality of healthcare in America, as well as in expeditiously identifying frivolous and unfounded claims of medical negligence that harm the integrity of the healthcare system while diverting valuable resources away from legitimate, meritorious claims.

This is exemplified by their commitment to providing thorough, unbiased, evidence based analysis of each and every case. One case at a time, our experts view their medicolegal work as an opportunity to improve the quality of healthcare in America. Every journey, no matter how great, begins with a single step.

Preventable medical mistakes are the third leading cause of death in the United States after heart disease and cancer. In 1999, the Institute of Medicine Report, "To Err is Human," uncovered that 98,000 Americans die annually from preventable and avoidable medical errors, each year. The root cause of medical malpractice is inexcusable medical error.
When the time arrives for our clients to retain an expert, they are investing in a case already deemed meritorious by our medical experts, not gambling with their funds blindly, by not knowing of the expert’s opinions beforehand.
